‍The Castor Stories application is published by GABEM Studio, a sole proprietorship registered with the RCS under SIREN number 989 769 047, with its headquarters located in France.

‍2. Purpose
‍The purpose of these General Terms of Use (“Terms”) is to define the conditions for accessing and using the Castor Stories mobile application (the “Application”).The Application allows users to automatically generate personalized stories for children based on parameters chosen by the user.
Access to the Application implies full, complete, and unconditional acceptance of these Terms by any user.

‍3. Conditions of Access and Use of Services
‍Use of the Castor Stories Application is personal and strictly for non-commercial purposes. Users agree not to use the Application for commercial, political, or advertising purposes, or for any form of solicitation.
Access to services is only possible from a compatible smartphone and/or tablet, after downloading and installing the Application.
Use of the Application requires an Internet connection. This connection is not provided by GABEM Studio; it is the user’s responsibility to subscribe to an appropriate Internet or mobile data plan. A 3G or higher connection is strongly recommended.
All costs relating to equipment (hardware, software, Internet subscription) required to access the service remain the sole responsibility of the user, who is also solely responsible for the proper functioning of their equipment and connection.

‍4. Description of Services
‍The Castor Stories Application offers users the ability to create personalized stories through several options:

‍Free offer: limited access to the generation of one (1) simple story, without companions or specific interactions.
‍
‍Monthly subscription: unlimited access to premium features (companions, interactions, audio narration, exclusive worlds, etc.) via an automatically renewing subscription. You can create up to 45 stories or chapters per month.
‍
The Application automatically generates illustrated content and narrative text based on the user’s responses to the chosen parameters.
Created stories may be stored and remain accessible to the user, even after deactivation of their subscription or account, unless expressly deleted by the user.

‍5. Right of Withdrawal
‍In accordance with Article L221-28 of the French Consumer Code, the user expressly acknowledges that the right of withdrawal does not apply to digital content provided on a non-tangible medium once execution has begun with their prior express consent and express waiver of the right of withdrawal.
By subscribing and immediately accessing the paid features of the Application, the user accepts that execution of the contract begins without delay and waives their right of withdrawal.

‍6. Content Creation via Artificial Intelligence
‍Stories are generated automatically by artificial intelligence based on parameters defined by the user.
GABEM Studio makes every effort to ensure the quality and relevance of generated stories, including through automated moderation and filtering mechanisms. However, the user acknowledges that GABEM Studio cannot guarantee the complete absence of inappropriate or unexpected content and cannot be held liable for generated content, which depends on the autonomous functioning of the algorithm used.
The user agrees to exercise discretion in using the service, particularly with content intended for young children.
A reporting channel is available via the contact address mentioned in Article 1.

‍7. Intellectual Property
‍All elements present in the Application (illustrations, texts, interfaces, graphics, sounds, animations, technologies, etc.) are the exclusive property of GABEM Studio or its contractual partners and are protected under applicable law.
The user is granted a personal, limited, non-exclusive, and non-transferable right to use the Application. Unauthorized reproduction, distribution, modification, or commercial exploitation is strictly prohibited.
User-generated stories may be saved or shared strictly for personal, non-commercial purposes.

‍8. Personal Data
‍GABEM Studio collects and processes certain personal data as part of the Application’s use, in compliance with applicable laws and GDPR.

‍9. Responsibilities
‍GABEM Studio disclaims any responsibility in the following cases:Non-compliant or improper use of the Application;Temporary or permanent inability to access the service;Errors, omissions, interruptions, deletions, or technical failures beyond its control;Automatically generated content deemed inappropriate or incorrect;Indirect or intangible damages, such as loss of opportunity, use, data, or operations;Intrusion, viruses, or malfunctions related to an insecure technical environment;Incompatibility between the Application and certain user equipment or systems;Force majeure as defined under French law and jurisprudence (natural disaster, strike, war, network failure, etc.).
The user is solely responsible for how they use the Application and its relevance to their needs. They are responsible for protecting their equipment from intrusion or contamination.
While GABEM Studio ensures stories are designed for a young audience, the adult user remains fully responsible for information entered when customizing stories. It is their duty to ensure generated content is appropriate for the child recipient.

‍9.1. User Conduct and Moderation
‍The user agrees not to generate content that is:unlawful, offensive, hateful, defamatory, discriminatory, sexual, violent, or otherwise immoral;infringing on third parties’ rights, privacy, copyright, image, or reputation;inciting hatred, suicide, violence, terrorism, racism, antisemitism, or any form of discrimination.
GABEM Studio reserves the right to suspend or delete any account or content that violates these rules, without prior notice or compensation.
A reporting system is available for users to alert the team about inappropriate content.

‍10. Brand Ownership and Non-Affiliation
‍The name Castor Stories is an original creation of GABEM Studio.
It is not affiliated with, endorsed by, authorized by, or licensed by holders of rights to Father Castor or related entities.

‍10.1. Availability and Evolution of Services
‍The services offered via the Castor Stories Application are generally available 24/7, subject to technical constraints and access conditions outlined in these Terms.
However, GABEM Studio reserves the right, without notice or compensation, to temporarily suspend all or part of the Application’s services, particularly to:perform technical updates or functional improvements;carry out scheduled or urgent maintenance;respond to force majeure or security requirements.
Where possible, GABEM Studio will notify users of planned interruptions at least 24 hours in advance through the Application.
The user acknowledges that such interruptions may occur and releases GABEM Studio from liability, waiving any claims related to temporary service unavailability.
Any resemblance to existing brands, characters, or works is purely coincidental and does not imply any association or intent to cause confusion.
GABEM Studio does not claim any rights over third-party trademarks and is committed to respecting intellectual property rights.

‍11. Duration – Termination – Modification
‍These Terms apply for the entire duration of use of the Application. GABEM Studio reserves the right to amend these Terms at any time, with the applicable version being the one effective on the date of the last update.
Users are encouraged to consult the Terms regularly.
GABEM Studio reserves the right to immediately suspend or terminate, without notice or compensation, access to the Application or subscription of any user in the event of:violation of these Terms;unlawful or fraudulent behavior;non-payment or circumvention of access restrictions;clear violation of applicable law or third-party rights.
Users may also cancel their subscription at any time from the account management interface. Upon termination or expiration, access to paid features remains available until the end of the current period but is not renewed. Users retain access to their library of generated stories.
No refunds are provided for the current subscription period.

‍12. Governing Law and Jurisdiction
‍These Terms are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent courts under the jurisdiction of the Court of Appeal of Nice, unless otherwise required.
